STIPULATION AND ORDER REGARDING HEARING AND BRIEFING SCHEDULE FOR PENDING MOTION TO DISMISS FOR LACK OF PERSONAL JURISDICTION AND IMPROPER VENUE

JEFFREY S. WHITE, District Judge.

WHEREAS, on February 8, 2016, Defendant VDNA Trading, LLC ("VDNA") filed a motion to dismiss this action for lack of personal jurisdiction and improper venue, which motion was set for hearing on March 15, 2016;

WHEREAS, on February 18, 2016 this matter was reassigned to the Hon. Jeffrey S. White and all existing hearing dates were accordingly vacated;

WHEREAS, Plaintiff AliphCom, Inc. dba Jawbone ("Jawbone") requires additional time to investigate the jurisdictional issues presented by VDNA's motion and prepare its response to VDNA's arguments;

WHEREAS, Jawbone's opposition brief would otherwise be due on February 22, 2016;

WHEREAS, there have been no prior time modifications in the case; and

WHEREAS, the schedule proposed in this stipulation will not have any effect on the overall schedule for the case;

NOW, THEREFORE, the parties hereto, through their undersigned attorneys and subject to the approval of the Court, stipulate to the following schedule for briefing and hearing VDNA's motion:

Jawbone's opposition papers shall be filed on or before March 11, 2016.

VDNA's reply papers shall be filed on or before March 25, 2016.

VDNA's jurisdictional motion shall be heard on April 8, 2016 at 9:00 a.m. in Courtroom 5, Oakland Courthouse, 1301 Clay Street, Oakland, California.

PURSUANT TO STIPULATION, IT IS SO ORDERED.
