ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

Pursuant to 28 U.S.C. § 636, the Court has reviewed the records on file, including the operative First Amended Complaint filed by Plaintiff Keith Dashiell Humdy ("Plaintiff") against Defendants C. Wilcher, R.N. and K. Donnelly, R.N. ("Defendants"), Defendants' Motion for Summary Judgment ("Motion") and all papers filed in support thereof, Plaintiff's Opposition to the Motion and all papers filed in support thereof, Defendants' Reply, and the Report and Recommendation of the assigned United States Magistrate Judge. No party has filed any written objections to the report.
IT IS HEREBY ORDERED that:
1. The Report and Recommendation is approved and accepted.
2. Defendants' Motion is GRANTED;
3. Plaintiff's First Amended Complaint is dismissed without prejudice; and
4. Judgment shall be entered accordingly.
