ORDER DENYING PLAINTIFF'S MOTION TO STRIKE
CHARLES R. BREYER, District Judge.
This case concerns allegations that a single photograph was posted on a website without permission and without proper identifying information. See Compl. (dkt. 1) ¶¶ 10-18. On June 30, 2017, the Court denied Defendant's motion to dismiss one of Plaintiff's two claims and ordered the parties to participate in mediation. See H'rg (dkt. 28). Three weeks later, Plaintiff nevertheless filed a motion to strike Defendant's affirmative defenses "not in an effort to be overly litigious but rather to streamline this case . . . ." See MTS (dkt. 31) at 2.
The Court DENIES Plaintiff's motion to strike without prejudice and VACATES the hearing set for August 18, 2017. Should it prove necessary, Defendant's affirmative defenses may be litigated at trial.
