JOINT STIPULATION FOR EXTENSION OF TIME AND ORDER

(Second Request)

IT IS HEREBY STIPULATED, by the parties, through their respective counsel of record, that the time for responding to Plaintiff's Motion for Remand be extended from December 13, 2018 to January 16, 2019. This is Defendant's second request for extension. Good cause exists to grant Defendant's request for extension. Counsel has a Ninth Circuit answering brief due next week which requires extensive and multiple levels of review by the agency and U.S. Attorney's Office. Counsel also has a Ninth Circuit oral arguments scheduled for the following week that also requires significant preparation and moot courts. Counsel was recently out of the office due to family emergency and health issues. Due to Counsel's unexpected leave and heavy workload, Counsel needs additional time to adequately review the transcript and properly respond to Plaintiff's Motion for Summary Judgment. Defendant makes this request in good faith with no intention to unduly delay the proceedings. The parties further stipulate that the Court's Scheduling Order shall be modified accordingly.

APPROVED AND SO ORDERED.
