ORDER DIRECTING PARTIES TO FILE STATUS REPORT

On September 16, 2016, the Court set trial and pretrial dates in the above-titled action, and, on November 22, 2016, extended to March 15, 2017, the deadline for the parties to complete court-sponsored mediation.

The Court has been advised by the ADR Unit that no mediation has been conducted, based on the parties' apparent understanding that the action had been stayed until resolution of a pending bankruptcy proceeding.

As acknowledged in the Notice of Stay, however, the stay is "effective only as to defendant Monument Security, Inc." (See Notice, filed Feb. 27, 2017.)

Accordingly, the parties are hereby DIRECTED to file, no later than April 21, 2017, a joint report apprising the Court as to the status of the case, including how the parties wish to proceed as to defendant RD/JET, LLC, erroneously sued as Jetro Holdings, LLC, as to which no stay has been entered.

IT IS SO ORDERED.
