DECISION ON ATTORNEYS' FEES AND COSTS1

On March 11, 2016, Christine Miners ("petitioner") filed a petition for compensation under the National Vaccine Injury Compensation Program, 42 U.S.C. §300aa-10, et seq.,2 (the "Vaccine Act" or "Program"). Petitioner alleged that she suffers from a shoulder injury to include "mild adhesive capsulitis with impingement type symptoms" caused by the influenza vaccine she received on October 6, 2014. Petition at ¶¶ 1, 4, 6, 8. On January 4, 2017, the undersigned issued a decision awarding compensation to petitioner based on respondent's proffer to which petitioner agreed. (ECF No. 29).
On April 7, 2017, petitioner filed an unopposed motion for attorneys' fees and costs. (ECF No. 33).3 Petitioner requests attorneys' fees in the amount of $11,619.70 and attorneys' costs in the amount of $641.36 for a total amount of $12,261.06. Id. at ¶¶ 2-3, 6. In compliance with General Order #9, petitioner has filed a signed statement indicating petitioner incurred no out-of-pocket expenses. See Exhibit 15, filed at the end of Pet. Motion (ECF No. 33). Additionally, in accordance with General Order #9, petitioner's counsel represents that petitioner incurred no out-of-pocket expenses. Pet. Motion at ¶ 4.
The Vaccine Act permits an award of reasonable attorneys' fees and costs. § 15(e). Based on the reasonableness of petitioner's request and the lack of opposition from respondent, the undersigned GRANTS petitioner's motion for attorneys' fees and costs.
Accordingly, the undersigned awards the total of $12,261.064 as a lump sum in the form of a check jointly payable to petitioner and petitioner's counsel Franklin John Caldwell, Jr.
The clerk of the court shall enter judgment in accordance herewith.5
IT IS SO ORDERED.
