ORDER

This cause is before the Court on pro se Motion of Defendant Kenneth G. Lassiter seeking clarification of Defendant Lassiter's status, and seeking removal of the federal hold on Defendant Lassiter. (Exhibit A).

While Defendant Lassiter was on supervised release, Defendant Lassiter was arrested and charged with new criminal conduct, Robbery with Firearm or Deadly Weapon, and Grand Theft 3rd Degree More Than 300 Less Than 20000, for which Defendant Lassiter was sentenced in the Circuit Court of Brevard County, Case No. 05-2013-CF-066269-AXXX-XX. Defendant Lassiter is in custody of the State of Florida serving the sentence imposed in that case.

Violation of a condition of supervised release is a separate offense from the offense for which Defendant Lassiter was charged in Case No. 05-2013-CF-066269-AXXX-XX. On November 6, 2013, the United States Probation Office petitioned the Court for issuance of a warrant, and the Court issued the warrant, which remains pending. The Court cannot unilaterally rescind the warrant. Defendant Lassiter's alleged violation of a condition of supervised release has not been adjudicated. It is not clear to the Court that Defendant Lassiter's federal sentence has expired. Accordingly, it is

ORDERED that Defendant Lassiter's request to remove the federal hold on Defendant Lassiter is denied. The Clerk of Court shall provide a copy of this Order to pro se Defendant by U.S. Mail.

MOTION FOR CLARIFICATION OF STATUS

I'm writing Because even thou my federal sentence parole and probation have lowg since expired the state is still showing a fed hold.

In my state case 05-2013-CF-066267-AXXX-XX Judge Cranford Specifically states that this sentence is to now community with any other sentence and all counts in this judgment "pertinent part of judgment and commitment attached and highlighted"

Because of fed hold in uneligible for work release and or re-entry programs please let me know how I can get feed hold removed as I am getting short and would like resolve any federal issues along with my state commitment.

I find myself once more writing to request your help. Ken was released in 2006 from Federal Custody after 19 years, was doing very well for 5 years. Had an actual position as Superintendent of a Golf Course locally (Aquarina). He unfortunately met someone (no real excuses here), fell in love with her and her 8 year old son, married. From that point on, his life went down hill. She has an addiction to Prescription Drug problem, and Ken also became once again addicted.

He subsequently committed attempted robbery, was apprehended, and went once again into custody. He is now eligible for parole/work release after serving most of his sentence. There is however the federal Marshall's hold which needs to be vacated. I've attached as much information as I have, and am requesting that the Marshall hold be lifted.

I have legal custody of his step son, Nicholas Arnold. His mother abandoned him after Ken was arrested, his birth father was, and is, in jail. Nick is a good grandson to me.

Please let me know if you need additional information. Any help you or your staff could provide would be greatly appreciated.
