ORDER ADOPTING MAGISTRATE'S REPORT AND RECOMMENDATION

JOSE E. MARTINEZ, District Judge.

THE MATTER was referred to Magistrate Judge Frank J. Lynch Jr, on July 30, 2013. A Report and Recommendation was filed on August 5, 2013, (D.E.#26), recommending that the Defendant's plea of guilty be accepted. The Defendant and the Government were afforded the opportunity to file objections to the Report and Recommendation, however none were filed. The Court has conducted a de novo review of the entire file. Accordingly, it is

ORDERED AND ADJUDGED that

The Report and Recommendation of United States Magistrate Judge Frank J. Lynch Jr, is hereby Adopted and Approved in its entirety.

The Defendant is adjudged guilty to Counts One, Two and Three of the three count Indictment which charges the Defendant in Count One with possessing with intent to distribute a controlled substance-Methylone, in violation of Title 21, United States Code, Sections 841(a)(1) and (b)(1)(C); in Count Two with possessing a firearm in furtherance of a drug trafficking crime, in violation of Title 18, United States Code, Section 924(c)(1)(A)(ii); and in Count Three with possession of a firearm by a convicted felon, in violation of Title 18, United States Code, Section 922(g)(1).

DONE AND ORDERED.
