This cause comes on for consideration upon the Magistrate Judge's Report and Recommendation dated December 19, 2017. (Doc. 24). The parties have been furnished a copy of the Report and Recommendation and have been afforded an opportunity to file objections pursuant to Title 28, United States Code, Section 636(b)(1). No objections have been filed.
Having considered the Report and Recommendation, I have determined that it should be adopted.
Accordingly, it is ORDERED:
1. The Magistrate Judge's Report and Recommendation (doc. 24) is adopted and incorporated by reference in this order.
2. The petition for writ of habeas corpus (doc. 1), challenging the judgments of conviction and sentences in State of Florida v. James Joseph Fountain, Santa Rosa County Circuit Court Case Nos. 11-CF-1050 and 11-CF-1065, is DENIED.
3. The clerk is directed to close the file.
4. A certificate of appealability is DENIED.
