The above matter comes before the Court upon the Report and Recommendation of United States Magistrate Judge Becky R. Thorson dated March 4, 2016. IT IS HEREBY ORDERED that:
1. Plaintiff Cheri Dietrich's motion for default judgment (Doc. No. 43) is DENIED;
2. Defendant Soo Line Railroad Company d/b/a Canadian Pacific's motion to dismiss or, in the alternative, for summary judgment (Doc. No. 36) is GRANTED; and
3. Dietrich's amended complaint (Doc. No. 23) is DISMISSED WITH PREJUDICE pursuant to Fed. R. Civ. P. 12(b)(6) for failure to state a claim on which relief may be granted.
