UNOPPOSED MOTION TO CONTINUE REVOCATION HEARING
JOHN M. GERRARD, Chief District Judge.
Comes now Joshua Huff, by and through Assistant Federal Public Defender Jessica L. Milburn, and requests that the Court continue his hearing on revocation of supervised release. In support of his motion, he states the following:
1. Mr. Huff has been screened and accepted into a long term treatment program at the ARCH in Omaha, NE, and he is currently on the waiting list for placement. Mr. Huff still has aspirations at attending treatment as a condition of his release.
2. Mr. Huff's probation officer opposes any plan for release.
3. Mr. Huff is requesting this continuance nonetheless. It will be the Magistrate's decision as to whether a placement at the ARCH is appropriate.
4. AUSA Steven Russell does not oppose this request for a continuance.
5. Mr. Huff is requesting that his hearing be continued for 45 days. It is expected that space will become available at the ARCH within this period of time. He asserts that 45 days will permit him time enough to file a motion to be heard in front of the Magistrate to determine whether he can be released to the ARCH.
Wherefore, Mr. Huff requests that the Court enter an Order continuing his revocation hearing for 45 days for the above stated reasons.
