ORDER DENYING MOTION TO DISMISS

Defendant Hector Feliz Arias-Arias (Arias-Arias) is charged by indictment with one count of illegal reentry into the United States in violation of 8 U.S.C. § 1326. D.E. 6. Based on United States v. Pedroza-Rocha, No. 18-50828, 2019 WL 3727828 (5th Cir. Aug. 8, 2019), the Court DENIES the motion to dismiss.
