JASON BOATRIGHT, Justice.
Based on the Court's opinion of this date, we CONDITIONALLY GRANT relator's August 3, 2017 petition for writ of mandamus in part. We ORDER the trial court to make a written ruling, within fifteen (15) days of the date of this opinion, on relator's October 15, 2012 motion to re-open case. We further ORDER the trial judge to file with this Court, within twenty-one (21) days of the date of this order, a certified copy of its order(s) issued in compliance with this order and the Court's opinion of this date. Should the trial court fail to comply with this order, the writ will issue.
We DENY relator's petition for writ of mandamus to the extent it asks the Court to order the trial court re-open the case and set the case for trial.
We ORDER the real parties in interest, Jerry Alexander and Billy D. Wyatt, to pay the costs, if any, of this original proceeding.
