SHIVA V. HODGES, Magistrate Judge.
Plaintiff, proceeding pro se and in forma pauperis, brought this action alleging violations of his constitutional rights pursuant to 42 U.S.C. § 1983. On April 10, 2015, the undersigned granted defendants' motion for an extension [ECF No. 30], and the Clerk of Court mailed Plaintiff a copy of the order on April 13, 2015 [ECF No. 32]. On April 23, 2015, the order was returned to the Clerk's office as undeliverable. [ECF No. 33]. On the returned envelope is a handwritten notation that states "Released." Id. On April 24, 2015, the undersigned recommended this matter be dismissed for Plaintiff's failure to prosecute, as the court had no means of contacting him concerning the case. [ECF No. 34]. In so recommending, the undersigned noted that Plaintiff had previously been advised to advise the court of any change of address by order dated November 19, 2014:
[ECF No. 8 (emphasis in original)].
On April 30, 2015, the court received a notice of change of address from Plaintiff, who provided an address of "3444 Broadriver Road, Columbia, SC 29210." [ECF No 36]. As a result, the undersigned vacated the prior recommendation to dismiss the case. [ECF No. 38]. Since that time, the court has received on May 18, 2015, May 26, 2015, and June 1, 2015, returned mail sent to Plaintiff's updated address. [ECF Nos. 44, 45, 46]. Plaintiff has again failed to keep the court apprised of his address, and as a result, neither the court nor the defendants have any means of contacting him concerning his case.
Based on the foregoing, it is recommended that this action be dismissed with prejudice, in accordance with Fed. R. Civ. P. 41(b). The Clerk is directed to send this Report and Recommendation to Plaintiff at his last known address. If Plaintiff notifies the court within the time set for filing objections to this Report and Recommendation that he wishes to continue with this case and provides a current address, the Clerk is directed to vacate this Report and Recommendation and return this file to the undersigned for further handling. If, however, no objections are filed, the Clerk shall forward this Report and Recommendation to the district judge for disposition.
IT IS SO RECOMMENDED.
