We have reviewed the record and find no reversible error. Accordingly, we affirm for the reasons stated by the district court. Smith v. Charleston County School District, No. 2:06-cv-02177-DCN (D.S.C. May 8, 2008). We deny Smith’s application for leave to proceed in forma pauperis as moot, as in forma pauperis status has already been granted. We also deny Smith’s motion for oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process. AFFIRMED 2
