UNITED STATES of America, Plaintiff-Appellee,
v.
Robert Allen CARTER, Defendant-Appellant.
No. 91-6519.
United States Court of Appeals, Fourth Circuit.
Submitted April 8, 1991.
Decided April 26, 1991.
As Amended May 6, 1991.
Appeal from the United States District Court for the District of South Carolina, at Columbia. Joe F. Anderson, Jr., District Judge. (CR-88-368, CA-90-1816-3)
Robert Allen Carter, appellant pro se.
John M. Barton, Office of the United States Attorney, Columbia, S.C., for appellee.
D.S.C.
AFFIRMED.
Before MURNAGHAN, SPROUSE and NIEMEYER, Circuit Judges.
PER CURIAM:
Robert Allen Carter appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255. Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Carter, CR-88-368, CA-90-1816-3 (D.S.C. Jan. 4, 1991). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
AFFIRMED.
