Bertual L. HOLLAND, Petitioner--Appellant,
v.
Earl BESHEARS, Warden, Respondent--Appellee.

No. 94-7292.

United States Court of Appeals, Fourth Circuit.

Submitted: February 16, 1995
Decided: March 20, 1995

Bertual L. Holland, Appellant Pro Se.

Before HAMILTON and MOTZ, Circuit Judges, and CHAPMAN, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying relief on his 28 U.S.C. Sec. 2241 (1988) petition.* Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Holland v. Beshears, No. CA-94-2855-MJG (D. Md. Oct. 31, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED

*

As the district court noted, Appellant's action was incorrectly captioned as one pursuant to 28 U.S.C Sec. 2254 (1988)
