UNITED STATES of America, Plaintiff--Appellee,
v.
Leslie Duanne GAINER, Defendant--Appellant.

No. 95-6459.

United States Court of Appeals, Fourth Circuit.

Submitted: June 20, 1996
Decided: June 27, 1996

Leslie Duanne Gainer, Appellant Pro Se. Michael Lee Keller, OFFICE OF THE UNITED STATES ATTORNEY, Charleston, West Virginia, for Appellee.

Before HALL, WILKINS, and HAMILTON, Circuit Judges.

PER CURIAM:

1

Appellant appeals from the district court's order denying his 28 U.S.C. § 2255 (1988) motion. We have reviewed the record and the district court's opinion accepting the recommendation of the magistrate judge and find no reversible error. Accordingly, we deny a certificate of appealability and dismiss on the reasoning of the district court. United States v. Gainer, Nos. CR-90-245; CA-94-1112-5 (S.D.W.Va. Mar. 6, 1995). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

DISMISSED
