After examining the briefs and appellate record, this panel has determined unanimously that oral argument would not materially assist the determination of this appeal. See Fed. R.App. P. 34(a); 10th Cir. R. 34.1.9. The case is therefore ordered submitted without oral argument.

Before this court is Appellant's motion for issuance of certificate of probable cause. We issue a certificate of probable cause and proceed to the merits of Appellant's appeal.

After carefully reviewing the district court's Order, the record, and the parties' briefs on appeal, we affirm for substantially the same reasons given by the district court in its Order dated March 8, 1994.

AFFIRMED. The mandate shall issue forthwith.
