 1       UPON DUE CONSIDERATION of this petition for review of a

 2   Board of Immigration Appeals (“BIA”) decision, it is hereby

 3   ORDERED, ADJUDGED, AND DECREED, that the petition for review

 4   is DENIED.

 5       Petitioner Eber Rolando Garcia Vasquez, a native and

 6   citizen of Guatemala, seeks review of a November 16, 2010,

 7   order of the BIA, affirming an October 29, 2008, decision of

 8   Immigration Judge (“IJ”) Annette S. Elstein, which denied

 9   his application for asylum and withholding of removal.       In

10   re Garcia Vasquez, No. A073 538 113 (B.I.A. Nov. 16, 2010),

11   aff’g No. A073 538 113 (Immig. Ct. N.Y. City Oct. 29, 2008).

12   We assume the parties’ familiarity with the underlying facts

13   and procedural history in this case.

14       Under the circumstances of this case, we have reviewed

15   both the IJ’s and the BIA’s opinions.       See Chen v. BIA, 435

16 F.3d 141
, 144 (2d Cir. 2006).       The applicable standards of

17   review are well established.    See 8 U.S.C. § 1252(b)(4)(B);

18   Weng v. Holder, 
562 F.3d 510
, 513 (2d Cir. 2009).

19       The agency’s finding that Garcia Vasquez failed to meet

20   his burden of demonstrating a well-founded fear of

21   persecution is supported by substantial evidence. See 8

22   U.S.C. § 1252(b)(4)(B).   With respect to Garcia Vasquez’s

23   civil defense patrol claim, the agency reasonably concluded

 1   that the death of local civil defense patrol leader Panfilo

 2   DeLeon constitutes a fundamental change in circumstances

 3   sufficient to rebut the presumption of a well-founded fear

 4   arising from any past persecution.    See 8 C.F.R.

 5   § 208.16(b)(1)(i)(A).   While Garcia Vasquez argues that

 6   DeLeon’s family members remain in power and could make

 7   reprisals against him, he fails to offer any evidence

 8   showing that he was ever threatened or harmed by any of

 9   DeLeon’s family and Garcia Vasquez’s wife and children have

10   remained in Guatemala without incident.    See Huang v. INS,

, 313 (2d Cir. 1999).    Moreover, although Garcia

13   Vasquez argues that many former civil defense patrol members

14   have retained power by infiltrating local government, he

15   fails to offer any evidence showing that these individuals

16   exercise their power to target former deserters, and Garcia

17   Vasquez’s desertion occurred more than twenty years ago.

18       Moreover, Garcia Vasquez’s unsupported assertion that 8

19   C.F.R. § 1240.26(i), which provides that “any grant of

20   voluntary departure shall terminate automatically upon the

21   filing of the petition or other judicial challenge,” is

22   invalid and that the filing of his appeal should not have

 1   terminated his grant of voluntary departure, is without

 2   merit.    See Dada v. Mukasey, 
554 U.S. 1
, 20 (2008); accord

 3   Mahmood v. Holder, 
570 F.3d 466
, 470 (2d Cir. 2009).     The

 4   United States Supreme Court has held that an “alien must be

 5   permitted to withdraw, unilaterally, a voluntary departure

 6   request before expiration of the departure period” in order

 7   to safeguard the alien’s right to further pursue

 8   proceedings.     See 
Dada, 554 U.S. at 20
; see also 8 C.F.R.

 9   § 1003.4.

10       Because the agency reasonably determined that there was

11   a fundamental change in circumstances and that Garcia

12   Vasquez failed to meet his burden of showing a well-founded

13   fear of persecution separate from his past persecution, we

14   decline to consider the agency’s alternative findings that

15   Garcia Vasquez failed to establish past persecution and a

16   nexus between any past persecution suffered and a protected

17   ground.     See Xiao Ji Chen v. U.S. Dep’t of Justice, 
471 F.3d 18
  315, 339 (2d Cir. 2006).    We further decline to consider

19   Garcia Vasquez’s argument that he is entitled to a grant of

20   humanitarian asylum, as it was not raised before the agency.

1        For the foregoing reasons, the petition for review is

2    DENIED.   As we have completed our review, any stay of

3    removal that the Court previously granted in this petition

4    is VACATED, and any pending motion for a stay of removal in

5    this petition is DISMISSED as moot.    Any pending request for

6    oral argument in this petition is DENIED in accordance with

7    Federal Rule of Appellate Procedure 34(a)(2), and Second

8    Circuit Local Rule 34.1(b).
