UNITED STATES of America, Plaintiff Appellee,
v.
Rodney Henry DUBAY, Defendant Appellant.
No. 93-6179.
United States Court of Appeals, Fourth Circuit.
Submitted Dec. 2, 1993.
Decided March 21, 1994.
Appeal from the United States District Court for the Eastern District of North Carolina, at Fayetteville. Malcolm J. Howard, District Judge. (CR-90-22-3-H, CA-92-135-3-H)
Rodney Henry Dubay, appellant pro se.
James R. Dedrick, United States Attorney, Raleigh, NC, for appellee.
E.D.N.C.
AFFIRMED.
Before HALL, NIEMEYER, and HAMILTON, Circuit Judges.
PER CURIAM:
Rodney Henry Dubay appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Dubay, Nos. CR-90-22-3-H; CA-92-135-3-H (E.D.N.C. Jan. 11, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
