UNITED STATES of America, Plaintiff Appellee,
v.
James Henry GARRISON, Jr., Defendant Appellant.
No. 93-7046.
United States Court of Appeals, Fourth Circuit.
Submitted: July 19, 1994.
Decided: August 2, 1994.
Appeal from the United States District Court for the Western District of Virginia, at Roanoke. James C. Turk, District Judge. (CR-90-79, CA-92-452-R)
Jonathan Mitcalfe Apgar, Damico & Apgar, Roanoke, Virginia, for Appellant.
Ray Burton Fitzgerald, Jr., Office of the United States Attorney, Roanoke, Virginia, for Appellee.
W.D.Va.
AFFIRMED.
Before HALL, LUTTIG, and WILLIAMS, Circuit Judges.
PER CURIAM:
Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Garrison, No. CR-90-79; No. CA-92-452-R (W.D.Va. June 4, 1992). We deny Appellant's motion for oral argument and dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
AFFIRMED.
