UNITED STATES of America, Plaintiff Appellee,
v.
Leroy BOONE, Defendant Appellant.
No. 94-6287.
United States Court of Appeals, Fourth Circuit.
Submitted Aug. 25, 1994.
Decided Sept. 27, 1994.
Appeal from the United States District Court for the Eastern District of Virginia, at Norfolk. John A. MacKenzie, Senior District Judge. (CR-90-149-N, CA-93-1244-N)
Leroy Boone, Appellant Pro Se.
Albert David Alberi, Special Assistant United States Attorney, Virginia Beach, Virginia, for Appellee.
E.D.Va.
AFFIRMED.
Before RUSSELL and MICHAEL, Circuit Judges, and PHILLIPS, Senior Circuit Judge.
PER CURIAM:
Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court.* United States v. Boone, Nos. CR-90-149-N; CA-93-1244-N (E.D. Va. Feb. 9, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
AFFIRMED
We deny Appellant's motion to appoint counsel
