PER CURIAM: Jose Juan Garcia appeals the district court’s order denying his request for a writ of mandamus pursuant to 12 U.S.C. § 1361 (1994), to compel the Immigration and Naturalization Service to commence deportation proceedings. We have reviewed the record and the district court’s opinion and find no reversible error. Accord- ingly, we affirm on the reasoning of the district court. Garcia v. INS, No. CA-98-40-2 (E.D. Va. Jan. 26, 1998). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process. AFFIRMED 2
