NOT FOR PUBLICATION

ORDER DENYING WITHOUT PREJUDICE DEBTOR'S APPLICATION FOR AUTHORITY TO EMPLOY THE ORANTES LAW FIRM, P.C. AS GENERAL INSOLVENCY COUNSEL AS OF SEPTEMBER 16, 2016

Having read and considered the Debtor's Application For Authority To Employ The Orantes Law Firm, P.C. As General Insolvency Counsel as of September 16, 2016 (the "Employment Application"), ECF 28, the notice thereof, ECF 29, and the statement of disinterestedness, ECF 27, the court makes the following comments and ruling:

1. The Employment Application and Notice thereon are defective and deficient because: (a) the Notice of the Employment Application, ECF 29, failed to advise the recipients that any response to the Employment Application and request for hearing pursuant to Local Bankruptcy Rule 9013-1(f) must be filed and served on the applicant (and counsel if any), and the United States Trustee not later than 14 days from the date of service of the notice, as required by Local Bankruptcy Rule 2014-1(b)(3)(E); (b) the Notice of the Employment Application lacks an authorized signature and is missing pages after page 7; and (c) pages 4 and 7 of the Employment Application, ECF 28, have different formatting from the other pages of the Employment Application with page borders on these pages whereas the other pages do not have page borders and apparently relate to a different bankruptcy case because counsel signed the page as "[Proposed] Attorneys for Debtor and Debtor-in-Possession All Ways Plumbing, Inc." and the client who signed the Employment Application is Michael Farrantino for himself as the client and neither All Ways Plumbing, Inc., nor Michael Farrantino is the debtor in this case (the debtor in this case is Lucid West Entertainment Group, LLC). 2. The Employment Application is denied without prejudice.

IT IS SO ORDERED.
