[PROPOSED] ORDER
HAVING READ AND DULY CONSIDERED PLAINTIFF'S REQUEST FOR DISMISSAL:
Pursuant to Federal Rule of Civil procedure 41(a)(1)(A)(i), Plaintiff OEC Logistics, Inc. dismissed Defendant with prejudice prior to Defendant's answer or responsive pleading. Further Defendant provided to Plaintiff a covenant not to sue, thereby resolving all open issues between the parties. Therefore, the Court hereby dismisses Plaintiff's Complaint with prejudice. Each party to bear their own costs.
