ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

IT IS THEREFORE ORDERED that Petitioner's request for a stay is denied and Judgment be entered denying the Petition for a Writ of Habeas Corpus, and dismissing this action without prejudice.
