WILLIAM B. SHUBB, District Judge.
Plaintiffs Scott Paulhus and Lynette Paulhus (collectively, "Plaintiffs") and defendants Caliber Home Loans, Inc.; Summit Management Company, LLC; and Fay Servicing, LLC (collectively, "Defendants") by and through their counsel of record, stipulate and agree as follows:
WHEREAS, the Court entered an order granting the Defendants' motions to dismiss Plaintiffs' complaint with leave to amend on May 30, 2014. Docket No. 31.
WHEREAS, Plaintiffs filed a first amended complaint on June 17, 2014. Docket No. 32.
WHEREAS, Defendants' responses to Plaintiffs' first amended complaint are due on July 7, 2014. See Fed. R. Civ. Pro. 15(a)(3), 6(d).
WHEREAS, Defendants intend to file motions to dismiss in response to Plaintiffs' first amended complaint.
WHEREAS, until those motions are resolved, it is unclear what claims and theories will be at issue in this case.
WHEREAS, the Court's and the parties' resources will be conserved by continuing the date of the initial scheduling conference, and the deadlines triggered by that date, until the anticipated motions to dismiss have been resolved.
THEREFORE, Plaintiffs and Defendants respectfully stipulate and request that the initial scheduling conference currently set for July 7, 2014, at 2:00 p.m. before Senior Judge William B. Shubb (see Docket No. 3) be continued to September 8, 2014, at 2:00 p.m. or to such later date at the convenience of the Court.
