YOU ARE HEREBY NOTIFIED this matter is confirmed for an eight (8) day jury trial on January 30, 2017, at 9:00 a.m., in courtroom 7. Due to this Court's high criminal and civil case load, the Court will not consider a request for continuance of this confirmed trial date. The parties shall file trial briefs not later than January 9, 2017. Counsel are directed to Local Rule 285 regarding the content of trial briefs.
Accordingly, a Final Pretrial Conference is set on December 1, 2016, at 2:00 p.m., in Courtroom 7. The Joint Final Pretrial Statement is due not later than November 17, 2016, and shall comply with the procedures outlined in the Court's Pretrial Scheduling Order (ECF No. 26). The personal appearances of the trial attorneys or person(s) in pro se is mandatory for the Final Pretrial Conference. Telephonic appearances for this hearing are not permitted.
Any evidentiary or procedural motions are to be filed by November 9, 2016. Oppositions must be filed by November 16, 2016 and any reply must be filed by November 23, 2016. The motions will be heard by the Court at the same time as the Final Pretrial Conference.
Due to the Court's high civil caseload, the parties are encouraged to consider consenting to a jury or nonjury trial before the assigned Magistrate Judge1 as well as availing themselves of the Court's Alternative Dispute Resolution programs.2 See E.D. Cal. Local Rs. 171, 301.
