STIPULATION AND ORDER TO EXTEND BRIEFING SCHEDULE

TO THE HONORABLE BARBARA A. MCAULIFFE, MAGISTRATE JUDGE OF THE UNITED STATES DISTRICT COURT:

The parties, by and through their respective counsel, hereby stipulate to extend the deadline in which plaintiff must file his opening brief for a period of 30 days from February 6, 2017, to and including March 8, 2017. Defendant's responsive brief shall be due no later than April 7, 2017, and plaintiff's reply brief shall be filed no later than April 21, 2017.

This request is made pursuant to paragraph 12 of the Court's Scheduling Order of June 8, 2016, permitting the filing of a single 30-day extension without the need for court approval.

IT IS SO STIPULATED.

ORDER

Pursuant to the stipulation of the parties, Plaintiff shall file his opening brief no later than March 8, 2017. Defendant's responsive brief shall be filed no later than April 7, 2017, and Plaintiff's reply brief, if any, shall be filed no later than April 21, 2017.

IT IS SO ORDERED.

1. Nancy A. Berryhill is now the Acting Commissioner of Social Security. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Nancy A. Berryhill should be substituted for Acting Commissioner Carolyn W. Colvin as the defendant in this suit. No further action needs to be taken to continue this suit based on 42 U.S.C. § 405(g).
