WILLIAM B. SHUBB, District Judge.
Pursuant to Federal Rule of Civil Procedure 6 and Local Rules 143(a)(1) and 144(a), the parties, by and through their attorneys of record, hereby stipulate as follows:
The minor Plaintiffs herein A.K., A.S., and A.K.M., have not yet had a guardian ad litem appointed to represent their interest in this matter. Under F.R.C.P. 17(c) the court must appoint a guardian ad litem or issue another appropriate order to protect a minor or incompetent person who is unrepresented in an action. Accordingly, the parties agree and stipulate that the Plaintiffs should have additional time to file a Motion seeking the appointment of a guardian ad litem to represent the interests of the minor children in this litigation. The parties further agree and stipulate that Defendants should not be required to file a responsive pleading until the court has entered an order appointing a guardian ad litem for the minors herein. Accordingly, Defendants, County of Sacramento, Jesse Gomez-Coates, Janelle Gonzales (erroneously named herein as Janelle Gonzalez), and Leona Williams shall have a further extension up to and including the twentieth day following the Court's entry of an Order appointing a guardian ad litem for the minor children herein to file their responsive pleading to the Second Amended Complaint.
