STIPULATION AND MODIFIED ORDER REGARDING BRIEFING ON CLASS CERTIFICATION MOTION

LUCY H. KOH, District Judge.

WHEREAS Lead Plaintiffs filed their Motion for Class Certification on February 11, 2011;

WHEREAS Defendants' papers in opposition to the motion are due by May 5, 2011;

WHEREAS Defendants consist of two separately represented groups: the Wells Fargo Defendants and the Underwriter Defendants;

WHEREAS Defendants believe that each group of separately represented Defendants is entitled under the Local Rules to file a separate opposition brief of 25 pages, for an aggregate total of 50 pages; and further believe that Lead Plaintiffs would be entitled to respond to such separate briefs with two reply briefs of 15 pages each, for an aggregate total of 30 pages;

WHEREAS Defendants request leave to file a joint brief to present the briefing in a way that Defendants believe will facilitate the orderly and efficient presentation of the issues;

WHEREAS Lead Plaintiffs do not object to Defendants' request for leave to file a joint opposition brief of no more than 40 pages provided, however, that Lead Plaintiffs are entitled to file a reply brief of no more than 24 pages;

NOW THEREFORE, IT IS HEREBY STIPULATED BY AND AMONG THE PARTIES HERETO THAT (a) Defendants may file a consolidated brief of no more than 35 pages in opposition to Lead Plaintiffs' Motion for Class Certification; and (b) Lead Plaintiffs may file a reply brief in support of the motion of no more than 20 pages.
