STIPULATION TO CONTINUE CHANGE OF PLEA HEARING; [PROPOSED] ORDER

MAXINE M. CHESNEY, District Judge.

Defendant Benjamin Lee Williams ("Mr. Williams"), by and through his counsel of record, and Assistant United States Attorney Kevin J. Barry, hereby stipulate and request that the change of plea hearing currently set for June 11, 2014, at 2:15 p.m., be continued to July 2, 2014, at 2:15 p.m., or as soon thereafter as possible. The reason for this request is because the parties are finalizing the details of the plea agreement and expect to reach an agreement in advance of the new July 2, 2014, hearing date.

Further, the parties agree and stipulate the ends of justice served by the granting of such a continuance outweigh the best interests of the public and the defendant in a speedy trial and that time within which the trial of this case must be commenced under the Speedy Trial Act should therefore be excluded under 18 U.S.C. § 3161 (to allow for effective preparation of counsel), from the date of the parties' stipulation, June 11, 2014, to and including July 2, 2014.

The parties have conferred, and hereby stipulate to continue the Supervised Release Revocation Hearing to July 2, 2014, at 2:15 p.m. The parties respectfully request the Court adopt this proposed stipulation.

[PROPOSED] ORDER

IT IS ORDERED that the currently scheduled Plea Hearing set for June 11, 2014, at 2:15 p.m. be continued to July 2, 2014, at 2:15 p.m.

IT IS FURTHER ORDERED that the ends of justice served by the granting of such a continuance outweigh the best interests of the public and the defendant in a speedy trial and that time within which the trial of this case must be commenced under the Speedy Trial Act should therefore be excluded under 18 U.S.C. § 3161 (to allow for effective preparation of counsel), from the date of the parties' stipulation, June 11, 2014, to and including July 2, 2014.

IT IS SO ORDERED.
