STIPULATION AND [PROPOSED] ORDER FOR TWO-DAYS EXTENSION OF DEFENDANTS' DEADLINE TO FILE REPLY MEMORANDUM IN FURTHER SUPPORT OF MOTION TO DISMISS THE THIRD AMENDED CLASS ACTION COMPLAINT
VINCE CHHABRIA, District Judge.
Pursuant to Local Rule 6-2 and Your Honor's Standing Order for Civil Cases, this Stipulation is entered into by and among Lead Plaintiff Police and Fire Retirement System of the City of Detroit ("Lead Plaintiff") and Defendants Epocrates, Inc., Rosemary A. Crane, and Patrick D. Spangler ("Defendants"), by and through their respective attorneys of record.
WHEREAS, on November 10, 2014, Defendants filed their Motion to Dismiss the Third Amended Class Action Complaint for Violations of the Federal Securities Laws (ECF No. 82) (the "Motion"), with a noticed hearing date of December 18, 2014;
WHEREAS, on November 24, 2014, Lead Plaintiff filed its opposition to the Motion (ECF No. 85);
WHEREAS, currently Defendants' reply brief is due on December 1, 2014;
WHEREAS, Defendants requested, and Lead Plaintiff agreed to, a short two-day extension of Defendants' deadline to file their reply brief, and good cause exists for the extension due to the Thanksgiving holiday; and
WHEREAS, this is the first request for a modification of the schedule for this Motion;
THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the parties hereto, that:
1. Defendants' reply is due on December 3, 2014.
2. Hearing Date on the Motion remains: December 18, 2014.
SO STIPULATED.
PURSUANT TO STIPULATION, IT IS SO ORDERED.
