ORDER DENYING MOTION TO DISQUALIFY

Defendant Kwok Cheung Chow has filed a motion to disqualify the Court pursuant to 28 U.S.C. § 144 and 28 U.S.C. § 455, "based on [the Court's] failure to identify and disclose a potential conflict of interest where his spouse's non-profit entity . . . was the recipient of a substantial ongoing annual grant originating from the Mayor's Budget for the Arts." Mot. (dkt. 1397) at 1-2. The Court, having reviewed the parties' filings, concludes that it is not biased or prejudiced, that there is no reasonable appearance of bias or prejudice, and that it has no interest that could have been substantially affected by the outcome of the proceedings. Accordingly, and for the reasons stated in the government's opposition brief (dkt. 1419), the motion is DENIED.

IT IS SO ORDERED.
