JOINT STIPULATION AND [PROPOSED] ORDER FOR DISMISSAL OF PLAINTIFFS' COMPLAINT WITH PREJUDICE

JOINT STIPULATION OF DISMISSAL

Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), the parties to this action, acting though counsel, hereby stipulate and agree that plaintiff will dismiss her Complaint against defendant Smith & Nephew, Inc., with prejudice. Each party to bear its own attorneys' fees and costs.

[PROPOSED] ORDER OF DISMISSAL

The parties' joint stipulation and [proposed] order for dismissal of plaintiff's Complaint with prejudice is approved. All of plaintiff's claims and any counter-claims are hereby dismissed with prejudice.
