JOINT STIPULATION TO EXTEND THE BRIEFING SCHEDULE ON DEFENDANT'S MOTION TO DISMISS PLAINTIFF'S SECOND AMENDED COMPLAINT

Plaintiff PAUL YALE ("Plaintiff") and Defendant WIZARDS OF THE COAST LLC ("Defendant") (collectively the "Parties"), by and through their respective counsel of record, submit the following Joint Stipulation to Extend the Briefing Schedule on Defendant's Motion to Dismiss Plaintiff's Second Amended Complaint.
WHEREAS, on September 22, 2017 Plaintiff filed his Second Amended Complaint in the above-captioned matter;
WHEREAS, on October 6, 2017 Defendant filed a Notice of Motion and Motion to Dismiss Plaintiff's Second Amended Complaint;
WHEREAS, the Court set the hearing for this motion for February 1, 2018, and ordered responses be due by October 20, 2017 and replies due by November 3, 2017;
WHEREAS, Plaintiff's counsel require an extension of one week's time through October 27, 2017 to prepare and file their opposition to Defendant's Motion due to other commitments of counsel;
WHEREAS, Defendants are amenable to Plaintiff's request for additional time in exchange for an extension of one week's time through November 10, 2017 to prepare and file their reply in connection with the Motion;
WHEREAS, there have been no prior extensions of the briefing schedule in connection with Defendant's Motion to Dismiss Plaintiff's Second Amended Complaint, and the requested extensions will not prejudice either party and all other Court deadlines remain unaffected;
NOW, THEREFORE, Plaintiff and Defendant, by and through their counsel of record and subject to Court approval, hereby stipulate that:
1. Plaintiff shall file his opposition on or before October 27, 2017;
2. Defendant shall file any reply in support of its Motion to Dismiss Plaintiff's Second Amended Complaint on or before November 10, 2017;
Pursuant to Civil Local Rule 5-1(i), the e-filing attorney hereby attests that concurrence in the filing of this document has been obtained from each of the other signatories, indicated by a conformed signature (/S/), which shall serve in lieu of their signatures on this e-filed document.
