ORDER FOR REVOCATION OF RELEASE PURSUANT TO 18 U.S.C. SECTION 3149(B)

Defendant Jaime Villela appeared before the undersigned for a bail violation hearing on April 1, 2019, pursuant to a bail violation notice of March 29, 2019. He is represented by CJA counsel Carleen Rae Arlidge. Assistance U.S. Attorney Marissa Harris and Pretrial Services Officer Kim Do were also present.

Previous bail violations were documented on August 23, 2018, August 30, 2018, January 24, 2019 and March 1, 2019. Defendant has from December 2018 to present demonstrated an inability to comply with conditions of release including but not limited to the prohibition against use of illegal substances. More specifically, the bail violations track persistent positive testing for marijuana use and a failure to engage in drug counseling in a meaningful manner which represent both a violation of Federal law and clear and convincing evidence of violation of conditions of release. It is the recommendation of Pretrial Services that Defendant Villela is no longer amenable to supervision and that he be remanded to custody. The Court questioned Pretrial Services regarding the availability of residential drug treatment through a local facility. Such assistance is available, however, given the Defendant's current level of non-compliance, it is not recommended.

The Defendant's level of non-compliance with his conditions of release, despite having received numerous admonitions from this Court, cause the Court to find that Defendant Villela is unlikely to abide by any condition or combination of conditions of release. Accordingly, the Court ORDERS as follows:

1. Defendant is remanded to custody of the U.S. Marshals to be detained pending further proceedings; 2. A bail status hearing is set for Thursday, April 11, 2019 at 1:30 p.m., at which time the Court will hear from defense counsel and Pretrial Services as to whether Defendant is a viable candidate for release on the condition of participation in a residential drug treatment program or whether there are other conditions of release that will enable Defendant more likely to abide by conditions of release.

IT IS SO ORDERED.
