RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by its duly designated Hearing Officer, K. N. Ayers, held a public hearing on the above matter April 28, 1975, at Miami, Florida.

There were no protestants.


  1. By this application, Florida Power and Light Company (Petitioner) seeks authority to construct a rockfilled pad in Biscayne Bay on which to erect a structure to carry a high voltage transmission line and metering equipment. The pad will start from the causeway at Card Sound and will extend from the northeast edge of the pavement into the water 18 to 19 feet. Approximately 170 cubic yards of limestone rock will be used to construct the triangular shaped pad which will extend about 1 to 1 and one-half feet above mean high water.


  2. The pad is required to erect and maintain the structure needed to carry the 138 KV transmission line to serve Keys Electric Co-op. Existing lines are unable to carry the additional power required.


  3. The application is governed by the provisions of Section 5, Chapter 74- 171, Laws of Florida, which authorizes reasonable improvement for public utility expansion. In the absence of opposition it is sufficient to say that the proposed installation is required and will not adversely affect the water quality of Biscayne Bay. It is therefore,


RECOMMENDED, that the application of Florida Power and Light Company be granted so as to authorize the construction of a small rockfill pad adjacent to the causeway at Card Sound in Biscayne Bay in accordance with the application submitted.
