RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings by its duly designated Hearing Officer, K. N. Ayers, held a public hearing on the above matter April 28, 1975, at Miami, Florida.

  1. By this application, Miami-Dade Water and Sewer Authority (applicant) seeks a permit so as to authorize the installation of a 16" Force Main across Biscayne Bay from S.E. 2nd Avenue to the Central District Waste Water Treatment Facility at Virginia Key, a distance of approximately four (4) miles. The project is part of Dade County Water Quality Plan and has been approved by all state agencies involved. The line will transport solids and sludge from the Northern District Plant to the Central Plant in Virginia Key for treatment. The line will be buried a minimum depth of four (4) feet below bottom, the trenched material placed upon barges or land until pipe is laid, one foot of lime rock will be placed in trench upon which the pipe will be laid, and the trench backfilled with the dredged material. During the installation turbidity booms will be installed and all requirements of state agencies will be met.


  2. This application is governed by the provisions of Sections 258.165(2)(a) and (5), Florida Statutes (Biscayne Bay Aquatic Preserve Act) which authorize such installations when required by the public interest and comply with all applicable laws.


  3. The waste treatment which this line will provide is required in the public interest and the applicant has obtained approval of all cognizant agencies. In the absence of opposition, the evidence need not be further delineated except to say the project is required in the public interest and the proposed construction will not adversely affect the water quality of Biscayne Bay. It is therefore,


RECOMMENDED that the Application of Miami-Dade Water and Sewer Authority be approved so as to authorize the installation of a 16" force main waste treatment

line across Biscayne Bay from S.E. 2nd Avenue to Virginia Key which is more fully described in the application and supporting documents.
