RECOMMENDED ORDER


After notice to the parties, a formal administrative hearing, pursuant to the Florida Administrative Procedures Act, was held in the County Commissioners Meeting Room, Bay County Courthouse Annex, Panama City, Florida, on May 9, 1975, before Delphene Strickland, Hearing Examiner.

ISSUES


Whether Respondent had violated Section 479.07(1), Florida Statutes, in that no permits were secured for subject sign for the years 1973-1975.


FINDINGS OF FACT


No permits were applied for or secured.


CONCLUSIONS OF LAW


Respondent is subject to the penalties of Section 479.17 and Section 479.10, Florida Statutes, inasmuch as the failure to secure permits is for the years 1973-1975.

RECOMMENDED ORDER


Dismiss petition inasmuch as Respondent has removed subject sign.
