RECOMMENDED ORDER

Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K.N. Ayers, held a public hearing on the above matter on June 17, 1975, in Ft. Lauderdale, Fl.

APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee, Florida, for the Board of Cosmetology; and

Peter Rose, Esquire, 400 International Bldg., 2455 E. Sunrise Blvd., Ft. Lauderdale, Fl. for the Respondent.

By this complaint the Florida State Board of Cosmetology seeks to revoke, annul, withdraw, or suspend the license of Wanda Dorsey individually and as president of LaWanda Beauty Salon, Inc. on the allegation that she did on February 13, 1975, allow Lucy Hermann to practice cosmetology in her salon without a Florida cosmetology License in violation of Section 477.02(6), Florida Statutes. Respondent entered a plea of no contest.

On February 13, 1975 the inspector for the cosmetology board visited LaWanda Beauty Salon on a routine inspection. He found Lucille Hermann working on a patron and upon inspection found she did not have a Florida operator's license. He advised Mrs. Dorsey, the owner of the shop, that he would have to issue a citation. There have been no previous violations on this shop.

From the foregoing it is concluded that Wanda Dorsey, individually and as president of Lawanda Beauty Salon, Inc. is guilty as charged. It is therefore,

RECOMMENDED that Wanda Dorsey, individually and as president of Lawanda Beauty Salon, Inc. be issued a letter of reprimand.
