RECOMMENDED ORDER
Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K. N. Ayers, held a public hearing on the above matters on June 17, 1975 in Ft. Lauderdale, Florida
APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee, for the Board of Cosmetology, and Stanley Needleman, Esquire, House Counsel, Frankel-Smith Beauty Salon, 120 East 16th St. New York, N. Y. 10003 for the respondent.
By this complaint, the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Frankel-Smith of Florida, Inc., on the grounds they did allow Becky Perry and Lois Vitola to practice Cosmetology in their salon without having a master cosmetologist present, in violation of Section 477.02(4), Florida Statutes.
The respondent acknowledged guilt of the offenses as alleged and advised that the situation with respect to having a master cosmetologist in the salon at all times had been straightened out at the corporate level, and it would not happen again. They now have 2 master cosmetologist present at the salon to cover all hours.
From the foregoing the hearing officer concludes that the respondent is guilty as charged. It is therefore,
RECOMMENDED that Frankel Smith of Florida be issued a letter of reprimand. DONE AND ENTERED this 3rd day of July, 1975, in Tallahassee, Florida.
