RECOMMENDED ORDER
Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K. N. Ayers, held a public hearing on the above matters on June 17, 1975 in Ft. Lauderdale, Florida.
APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee, Florida for the Board of Cosmetology.
By this complaint the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Louella Grayson on the grounds that she did on February 14, 1975 and on May 2, 1975, operate a beauty salon without the direct supervision of a master cosmetologist in violation of Sections 477.02(4) and 477.15, Florida Statutes. Exhibits 1 and 2, both being receipts for notice of hearing sent by certified mail, were received into evidence.
The inspector for the Board visited Grayson's Beauty Salon on February 14, 1975 on a routine inspection. At that time she found a Ms. Fields alone practicing cosmetology. There was no master cosmetologist present. Ms. Fields indicated that the master cosmetologist was out. Ms. Grayson is the owner of the salon and also holds a master cosmetology license. In addition, she has an additional master cosmetologist for the shop. The inspector revisited Grayson's Salon on May 2, 1975 on a normal inspection and found Ms. Fields again practicing cosmetology without the presence of a master cosmetologist. The operator did not say where the master cosmetologist was, but that Ms. Grayson was in Jacksonville at a funeral.
From the foregoing the Hearing Officer finds the respondent guilty as alleged. It is therefore,
RECOMMENDED that Louella Grayson d/b/a Grayson's Beauty Salon be issued a letter of reprimand.
