RECOMMENDED ORDER


Pursuant to notice, the Division 0f Administrative Hearings by its duly designated hearing officer, K. N. Ayers, held a public hearing on the above matter on June 17, 1975 in Ft. Lauderdale, Florida.

By this complaint the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Geri Louise Greenbaum on the grounds that on December 30, 1974 she did practice cosmetology without a valid certificate of registration in violation of Section 477.14(1) and 477.17 Florida Statutes. Exhibit 1, receipt ford Notice of Hearing sent by Certified Mail, was admitted into evidence.


On December 30, 1974 the inspector for the Board of Cosmetology visited Stonewall Beauty Salon on a regular inspection. Upon arrival he found that Geri Greenbaum Hinkle nee Geri Louise Greenbaum was working with an expired cosmetology certificate of registration.


The allegations charge a violation of provisions of the Florida Statutes which require that the cosmetologist renew his certificate of registration on or before July 1st of each year, and Section 477.17.F.S. cites the fees for such renewals. Failure to renew a certificate or registration will automatically result in a revocation of the right to practice cosmetology. It would appear appropriate to charge an individual operating without a valid certificate of registration, with violation of Section 477.02 of the Florida Statutes. Failure to renew a license is not grounds for the Board to take action by Administrative Hearings to revoke the license. From the foregoing it is concluded that Geri Greenbaum Hinkle is guilty as alleged. It is therefore,


RECOMMENDED that the complaint be dismissed.
