RECOMMENDED ORDER
Pursuant to notice, the Division of Administrative Hearings by its duly designated hearing officer, K.N. Ayers held a public hearing on the above matter on June 16, 1975, in Ft. Lauderdale, Florida.
APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee, Florida, for the Board of Cosmetology.
By this complaint, the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Leon P. Rizzuto d/b/a Jane's Beauty Shop on the grounds that he did on November 13, 1974, practice cosmetology on Mrs. T.A. Garrett without a Florida cosmetology's license and that he allowed Susan A. Roberts to practice cosmetology in his salon with an expired license in violation of Section 477.02(1) and (3), and Section 477.02(6), Florida Statutes. The attorney for the Board acknowledged that no service of the complaint was ever made upon Leon P. Rizzuto. Accordingly, it is,
RECOMMENDED that the case be placed in a suspended status until such time as service of the complaint has been made upon Leon P. Rizzuto d/b/a Jane's Beauty Shop.
