RECOMMENDED ORDER

Pursuant to notice, The Division of Administrative Hearings by its duly designated hearing officer, K. N. Ayers, held a public hearing on the above matter on June 17, 1975 in Ft. Lauderdale, Florida.

APPEARANCES: Ronald C. LaFace, Post Office Box 1752, Tallahassee Florida, for the Board of Cosmetology.

By this complaint the Florida State Board of Cosmetology seeks to revoke, annul, withdraw or suspend the license of Robert W. Ragucci, d/b/a Esplanade Coiffures on the grounds that on January 23, 1975 he did practice cosmetology without a salon license and without a valid master cosmetology license in violation of Section 477.02(1)(3) and (6) and 477.15 (8)(9), Florida Statutes. Exhibit 1, receipt for Notice of Hearing sent by certified mail, was admitted into evidence.

On January 23, 1975 the inspector visited Esplanade Coiffures on a normal routine inspection. On his arrival he found that Mr. Ragucci did not have a salon license and his personal license as a master cosmetologist had expired. Mr. Ragucci had purchased the salon approximately one year prior to the inspection.

From the foregoing it is concluded that Robert W. Ragucci d/b/a Esplanade Coiffures is guilty as alleged. It is therefore,

RECOMMENDED that Robert W. Ragucci d/b/a Esplanade Coiffures be issued a letter of reprimand.
