RECOMMENDED ORDER


After due notice a public hearing was held before Delphene Strickland, Hearing Officer, Department of Administration, Division of Administrative Hearings, on June 23, 1975, at 1:45

    1. in Suite 820, Barnett Bank Building, Tallahassee, Florida.

      ISSUE


      Whether Respondent allowed cosmetologists to work in Otto's Beauty Salon without a master cosmetologist being present.


      Whether Respondent's license should be revoked, annulled, withdrawn, or suspended.

      FINDINGS OF FACT


      1. Respondent appeared in person and admitted the violation as charged by the Complainant.


      2. Respondent is the occasional manager of Otto's Beauty Salon.


      3. Respondent is the master cosmetologist and the only master cosmetologist working in Otto's Beauty Salon.


      4. Respondent was absent from the shop as charged by the Board during working hours and during the time cosmetologists were working in said salon.


        CONCLUSIONS OF LAW


      5. Section 477.02(4), Florida Statutes, prohibits the operation of a cosmetology salon unless a registered cosmetologist is present at all times.


RECOMMENDED ORDER


Dismiss the complaint. Respondent was in violation of the statute, admits the ? and assures the inspector and the hearing officer that there will be no further violations.

FINAL ORDER


The Florida State Board of Cosmetology adopts as the agency's Final Order the Recommended Order of the Hearing Officer dated July 10, 1975, copy of which is attached hereto and incorporated herein by reference.


That the entry and publication of this Final Order shall constitute a reprimand or warning to the Respondent not to engage in a course of conduct in the future which would violate the Florida Cosmetology Law, Section 477, Florida Statutes or the Rules and Regulations of the State Board of Cosmetology.


A copy of this Final Order including the reprimand contained herein shall become a part of the Respondent's permanent file.
