RECOMMENDED ORDER


After due notice a public hearing was held before Delphene Strickland, Hearing Officer, Department of Administration, Division of Administrative Hearings, on June 23, 1975, at 2:30 p.m. in Suite 820, Barnett Bank Building, Tallahassee, Florida.

ISSUE


  1. Whether Respondent, Nancy Jo Gupton, allowed a non- licensed person to practice cosmetology in her beauty salon contrary to Florida Statutes.


  2. Whether Respondent's license should be revoked, annulled, withdrawn or suspended.


FINDINGS OF FACT


  1. Respondent is doing business as Nancy Jo's Hair Stylist in Jacksonville, Florida.


  2. Respondent was working in said salon and left the salon to take a customer to the hospital.


  3. Sue Dalton, a non-registered person washed and set the hair of one Mrs. Latham, a customer of said salon.


  4. Sue Dalton was not employed to serve as a cosmetologist.

    CONCLUSIONS OF LAW


  5. Chapter 477, Florida Statutes, requires each person practicing cosmetology to have a certificate of registration. Sue Dalton was practicing cosmetology in Respondent's salon and had no certificate to practice cosmetology contrary to the statute.


RECOMMENDED ORDER


Dismiss the complaint. The evidence shows that Sue Dalton was not employed as a cosmetologist although she did perform such service in Respondent's Beauty salon.
