RECOMMENDED ORDER


Pursuant to notice, the Division of Administrative Hearings, by its duly designated hearing officer, K. N. Ayers, held a public hearing in the above styled cause on December 17, 1975 at Ft. Myers, Florida.

By this Petition, the School Administration of Lee County, Florida seeks to expel Leroy Bass, Respondent herein, for engaging in a fight and throwing chairs on November 4, 1975.


On November 4, 1975 Leroy Bass engaged in a fight with another student in the common area. One of the teachers attempting to separate these two students grabbed the other participant in the fight. While he held the student, Bass continued to strike the student being held by the teacher. In addition and prior thereto, he was engaged in throwing chairs at other students and using abusive language.


During his time at the school Leroy Bass has had nine referrals in the last two years for offenses ranging from fighting on a bus, striking a teacher, skipping classes, disobedience, excessive tardiness and obscene language. As a result he has been a disruptive influence in the school and a continual cause of problems.


From the foregoing it is concluded that on November 4, 1975 Leroy Bass was engaged in fighting and throwing chairs as alleged. Throwing furniture is a very serious offense as the chairs involved are heavy and can cause serious injury if they strike another student. In view of his past history of disciplinary problems it is apparent that Leroy considers he can only exert his manhood and his independence by fighting. It is therefore,


RECOMMENDED that Leroy Bass be expelled from Riverdale High School.
